Elderly or Disabled Property Tax Deferral (Circuit Breaker)

Allows qualifying individuals the option to defer a portion of the property taxes owed on their permanent residence. Income must not exceed $56,850. Application deadline is June 1. Complete Form AV-9 

Disabled applicants must also have a NC licensed physician complete Form AV-9A Disability Certification on their behalf.

If you qualify, you may receive a deferral based on 4% or 5% of the applicant's income. 

 

Requirements:

Must be 65 or older or totally and permanently disabled.

Income from all sources does not exceed $56,850.

Must have owned and occupied the property as the owner's permanent residence for at least 5 years as of January 1st.

Must be a North Carolina resident.

 

The taxes over the limitation amount are deferred and remain as a lien on the property. The last three years of deferred taxes prior to the disqualifying event will become due and payable, with interest,  on the date of the disqualifying event. 

 

Program continuation

An annual application and proof of income is required for this tax relief program.

Applications for exclusion are reviewed by Henderson County based on the legal guidelines outlined by the North Carolina General Assembly in NCGS 105-277.1B.
