92-17. Termination of Franchise.
In the event the franchise is terminated, whether by revocation, expiration or otherwise, the grantee may continue to operate the cable system pursuant to the terms and conditions of the terminated franchise only upon the following terms and conditions:
- Continued operation of system. In the case of a revocation only upon the finding of the County Commissioners that the grantee's continued operation would not be harmful to the health, safety or welfare of the citizens of Henderson County and only upon the terms and conditions found necessary by the Board of County Commissioners.
- Renewal denied. In the event that the County denies renewal, the grantee shall be afforded a period of 6 months from the effective date of the final order denying renewal, including any appeal, within which to sell, transfer or convey the cable system and the franchise to a qualified purchaser. The grantee shall be afforded a period of 12 months to remove the distribution system and all service connections from poles and rights-of-way.
- Extension of franchise. Upon the expiration of a franchise, the County, on its own motion, may require the grantee to operate the franchise for an extended period of time not to exceed 12 months from the date of any such resolution. All provisions of the franchise shall continue to apply to operation during an extension. The County shall serve written notice at the grantee's business office of intent to extend under this section at least 30 days prior to the expiration of the original franchise.
