COUNTY OF HENDERSON MARCH 25, 1999
The Cane Creek Water
& Sewer District Board met for a special called meeting on Thursday, March
25, 1999 at 3:00 p.m. in the Commissioners= Conference Room of the Henderson County Office Building at 100 North
King Street, Hendersonville, North Carolina.
Present were: Chairman Grady Hawkins, Vice-Chair Bill
Moyer, Commissioner Marilyn Gordon, Commissioner Renee Kumor, Commissioner Don
Ward, County Manager David E. Nicholson, Assistant County Manager Angela S.
Beeker, and Acting Clerk, Avalina B. Merrill.

Chairman Hawkins
called for a motion to convene as the Cane Creek and Sewer District.
Commissioner Kumor made a motion to do so. All voted in favor and the motion
carried.
Cane Creek Water
and Sewer Advisory Board
Chairman Hawkins
advised the Board that Mayor Parrish, on behalf of the Town of Fletcher, made a
suggestion regarding the appointments to the Cane Creek Water and Sewer
Advisory Board. Mr. Hawkins summarized the suggestion: (a) Two appointments by
Fletcher to the Advisory Board as the largest user and revenue producer within
the District. One member would be a member of their Town Council; the other member
would be a property owner within the Town of Fletcher who is connected to the
System, possibly a representative of the industrial community. (b) The County,
as owners of the System, would have three members: One Commissioner, a member
residing outside the Cane Creek Water & Sewer District and one member who
is connected to the System but outside the town limits of the Town of Fletcher.
It was the consensus
of the Board to accept Mayor Parrish=s suggestion for the appointments to the Advisory Board.
Town of Fletcher
Projects/Grants
Chairman Hawkins
asked the Board to review and consider a resolution to permit the Town of
Fletcher to apply and receive grant assistance to aid in the construction and
maintenance of the Cane Creek Water and Sewer District projects within the Town
of Fletcher. It was the consensus of the Board to adopt the resolution as
drafted.
Interlocal
Agreement
Chairman Hawkins
asked the Board to review and consider an interlocal agreement between the
Board and the Town of Fletcher to establish some regulations for the public
wastewater collection lines of the Cane Creek Water and Sewer District within
the corporate limits of the Town of Fletcher. There was some discussion by the
Board. Commissioner Moyer recommended a text revision under General Provisions,
Item (d). He recommended a definitive sentence that would state the interlocal
agreement would be terminated if the grant application was denied for any
reason. Commissioner Moyer also questioned the significance of termination of
the interlocal agreement 6-30-2002. He expressed concern about the control of
collection rates when the interlocal agreement terminates in 2002 as stated. A
few other minor text revisions were recommended for clarifications of the
agreement.
Commissioner Kumor
made a motion for the Board to enter the interlocal agreement with the Town of
Fletcher with the recommended revisions incorporated. All voted in favor and
the motion carried.
Commissioner Moyer
made a motion to adjourn as the Cane Creek Water and Sewer District. All voted
in favor and the motion carried.
